Acceptance of terms
By accessing or using bpeatery.com (the "Site") or placing an order with BP Eatery ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site or place an order.
Products and pricing
All prices are listed in United States dollars (USD) and are subject to change without notice. We reserve the right to correct pricing errors, limit order quantities, and refuse or cancel any order at our discretion. Product availability and photography are subject to change.
All sales final
Our products are freshly baked, perishable goods. All sales are final — we do not accept returns and do not offer refunds or exchanges. If there is a problem with your order, please contact us within 48 hours of delivery or pickup at hi@bpeatery.com and we will do our best to make it right.
Shipping and local orders
Cookies ship US-wide via 2-day ground carriers. Drinks, floats, shakes, puddings, and drink + cookie combos are available for local pickup and local delivery in the Garden Grove, California area only and are never shipped. See our Shipping page for details.
Intellectual property
All content on the Site — including the BP Eatery name, logo, recipes, photography, copy, and design — is owned by BP Eatery or its licensors and is protected by U.S. and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
Limitation of liability
To the maximum extent permitted by applicable law, BP Eatery, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.
Allergens
Our products are baked in a shared kitchen that handles wheat, dairy, eggs, and various nuts. We cannot guarantee an allergen-free product. It is your responsibility to review ingredient information before ordering.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute shall be brought exclusively in the state or federal courts located in Orange County, California.
Changes to these terms
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
